Is FHWA approval required for all design-build advertisements?

Answer:
No, in the case of Federal-aid projects involving innovative contracting, FHWA's approvals will still be required for federal oversight projects as defined by the Stewardship and Oversight agreement (e.g., proprietary items, pavement designs, value engineering proposals, design exceptions). FHWA's approvals are needed for design-build projects in the following manner:
Low - Bid Design Build Selection Process: Approval of the Bid Package will constitute FHWA's project authorization and the approval of the request to the release the document.
Adjusted - Bid Design Build Selection Process: Approval of the Advertisement for the Statement of Interest and approval of the Bid Package will constitute FHWA's project authorization and the approval of the request to the release the document.
Currently, and until further notice, only the Low Bid Design Build method is available for use in Department projects.
